These General Terms and Conditions of Sale and Use ("Terms") are issued by:

SUNBERG SAS, operating the brand TRUE TRIBE, is hereinafter referred to as "TRUE TRIBE".
02 Scope of application and acceptance
These Terms govern all purchases of products and use of services offered on the website www.truetribe.paris (the "Site") by any visitor, browser, or purchaser (the "User").
These Terms apply exclusively to end consumers (natural persons acting for purposes outside their trade, business, craft, or profession, hereinafter "Consumers") and to legal entities making purchases for their own internal use. Resale, redistribution, or commercial use of TRUE TRIBE products is strictly prohibited without prior written authorisation.
Professional or business purchasers (B2B) seeking to acquire Products for resale, corporate gifting, uniforms, brand collaborations, or any commercial purpose must contact TRUE TRIBE directly at contact@truetribe.paris. Such transactions are governed by separate B2B terms negotiated in writing and not by these Terms.
Acceptance: Prior to placing an order, the User must expressly accept these Terms by ticking the corresponding box at checkout ("I have read and accept the General Terms and Conditions of Sale and Use"). Without such express acceptance, the order cannot be submitted.
TRUE TRIBE reserves the right to amend these Terms at any time. Amendments take effect upon publication on the Site. The Terms applicable at the time of order placement govern that contractual relationship.
03 Pre-contractual information
In accordance with Articles L.221-5 and L.111-1 of the French Consumer Code and Article 6 of EU Directive 2011/83/EU, TRUE TRIBE provides the following information prior to the conclusion of any distance contract:
The essential characteristics of each Product are described on the corresponding product page on the Site.
The total price of each Product, inclusive of applicable taxes, is displayed on the product page and at checkout. Any additional fees are disclosed prior to confirmation of the order.
The identity of the seller, its postal address, telephone number, and email address are set out in Article 1.
The applicable delivery and performance terms, including estimated delivery times, are set out in Article 10.
The statutory right of withdrawal, its conditions, time limits, and procedures are set out in Article 11.
The legal guarantees applicable to the Products are set out in Article 13.
The duration of the contract is the period necessary to fulfil the order. There is no automatic renewal.
The procedures for handling complaints are set out in Articles 11, 12, and 25.
The competent ADR mediator is identified in Article 25.
By placing an order, the User confirms having received and reviewed this pre-contractual information.
04 Conditions of use of the Site
The Site and all of its contents, including text, images, graphics, logos, trademarks, service marks, editorials, campaign visuals, videos, product names, fabric technology names, and designs, are the exclusive property of TRUE TRIBE or its licensors and are protected by French and international intellectual property law. All rights reserved.
TRUE TRIBE and all associated logos, product names, designs, visuals, and brand elements displayed on the Site are trademarks or protected intellectual property of SUNBERG SAS or its licensors. The campaign tagline "Wild By Nature" is used by TRUE TRIBE in connection with the brand identity and marketing communications. Product names and proprietary fabric designations used by TRUE TRIBE (including but not limited to AquaSilk, NoirSilk, NoirLite, MoonRoyal, NewLight, BreathAir, AngelWeave, AquaLite, AeroLite, Aqua Air, O₂ Lux, TerraLinen, TerraFibre, ElevaPima, and GizaFine) are protected as distinctive commercial designations under French law. Any unauthorised use, reproduction, imitation, or exploitation is strictly prohibited.
Reproduction, representation, modification, adaptation, translation, distribution, extraction, or exploitation of any element of the Site, in whole or in part, by any means whatsoever, without the prior written consent of TRUE TRIBE, is strictly prohibited.
Users are prohibited from using the Site:
For any unlawful or fraudulent purpose, or in violation of any applicable law;
To infringe upon the intellectual property rights of TRUE TRIBE or any third party;
To transmit viruses, malware, spyware, or any other harmful code;
To engage in phishing, hacking, data scraping, or any other unauthorised automated access;
To harass, intimidate, defame, or discriminate against any person.
TRUE TRIBE reserves the right to seek all available legal remedies, including criminal prosecution, against any User who violates the foregoing prohibitions.
The User agrees to provide accurate, complete, and current registration, account, and billing information, and to promptly update such information when necessary.
05 Accessibility
In accordance with Directive (EU) 2019/882 (European Accessibility Act), applicable from 28 June 2025, TRUE TRIBE is committed to making its Site accessible to persons with disabilities. The Site is designed to meet applicable accessibility requirements where reasonably practicable, including compatibility with assistive technologies.
Users encountering accessibility difficulties when browsing the Site or completing an order may contact TRUE TRIBE at contact@truetribe.paris for assistance. TRUE TRIBE will respond to accessibility requests within a reasonable timeframe and will endeavour to provide an alternative means of completing the transaction where required.
06 Products and catalogue
TRUE TRIBE offers a curated range of luxury menswear essentials, including swimwear, resort and loungewear, running apparel, and outerwear (the "Products"). The Products are those listed in the Catalogue on the Site at the time of the User's visit, subject to availability.
Product offers and prices are valid while they remain visible on the Site and within the limits of available stock. TRUE TRIBE shall not be liable for Products that are out of stock or unavailable for orders that have not yet been accepted.
TRUE TRIBE has made every reasonable effort to display the colours and appearance of its Products as accurately as possible. However, given that colour rendering may vary between devices and screens, TRUE TRIBE cannot guarantee perfect accuracy of colour representation.
Minor variations in colour rendering between screens and actual products do not in themselves constitute a lack of conformity, without prejudice to the consumer's statutory right of withdrawal and legal guarantees.
07 Pricing, currencies, and taxes
Prices on the Site are displayed in the User's selected currency, including euros (€), US dollars (USD), British pounds (GBP), and other currencies enabled by the Site for international markets. The reference currency for TRUE TRIBE is the euro (€).
All prices include applicable taxes calculated according to the User's shipping destination at checkout. For orders shipping within the European Union, prices include French VAT or destination-country VAT in accordance with the EU One-Stop Shop (OSS) scheme.
TRUE TRIBE's standard commercial offer is "Free Worldwide Shipping Over €150, All Tax & Duties Included" for qualifying orders. Where this offer applies, all duties and import taxes for international destinations are pre-paid by TRUE TRIBE under a Delivered Duty Paid (DDP) shipping arrangement, and the User will not be asked to pay additional duties on delivery. The DDP offer applies only where displayed at checkout and subject to destination eligibility under TRUE TRIBE's carrier and customs arrangements. Where a destination is not eligible for DDP, any applicable duties, taxes, and charges will be disclosed at checkout where possible, or will remain the responsibility of the recipient.
For orders that do not qualify for the DDP offer (for example, below the qualifying threshold or in destinations excluded from the offer), customs duties, import taxes, and local VAT may apply on import and are the responsibility of the User. The applicable shipping and tax conditions are clearly indicated at checkout prior to confirmation.
TRUE TRIBE reserves the right to modify its prices at any time. The price applicable to any order is that shown on the Site at the time the order is placed and confirmed.
08 Order process and formation of contract
Orders may be placed through the Site by adding Products to the shopping cart and completing the checkout process. The User must provide accurate shipping and billing information to proceed.
An order constitutes a binding offer by the User to purchase the selected Products. The contract of sale is concluded only upon TRUE TRIBE's express acceptance of the order, confirmed by a written order confirmation sent to the User's email address.
TRUE TRIBE retains title to all Products until full payment of the purchase price has been received.
TRUE TRIBE reserves the right, acting reasonably and in accordance with applicable consumer law, to refuse, limit, or cancel any order, including where:
The Product is out of stock or no longer available;
The User appears to be acting as a dealer, reseller, or distributor;
Multiple orders are placed under the same account, payment method, or delivery address in a manner suggesting commercial resale;
Billing or account information is inaccurate or incomplete.
This right is exercised in compliance with Article L.121-11 of the French Consumer Code.
09 Payment
Payment is accepted via the following methods:
Credit and debit cards: Visa, Mastercard, American Express;
Cartes Bancaires;
PayPal;
Apple Pay;
Shop Pay;
Any additional payment methods displayed at checkout.
The User's payment method is charged at the time of checkout, upon submission of the order. Following successful payment, the User will receive an order confirmation by email. This confirmation constitutes acceptance of the order by TRUE TRIBE, subject to stock availability.
Payment transactions are processed by certified payment service providers (Shopify Payments and PayPal). Such providers are PCI-DSS compliant. TRUE TRIBE does not store full payment card details on its servers. Payment data is encrypted in transit using TLS/SSL technology.
It is the User's responsibility to ensure the accuracy of all payment and account information.
10 Delivery and shipping
TRUE TRIBE delivers Products worldwide to all destinations indicated as available at checkout, in accordance with TRUE TRIBE's published Shipping Policy. Shipments are operated primarily by DHL and FedEx.
Estimated delivery times are provided for information purposes only and may vary depending on destination, customs clearance, carrier delays, peak periods, or circumstances beyond TRUE TRIBE's reasonable control. Except where otherwise required by applicable law, delivery times shall not constitute a contractual guarantee.
Delivery costs (where applicable) and any applicable duties are calculated at checkout and communicated to the User prior to confirmation of the order, in line with the pricing and tax conditions set out in Article 7.
The User is responsible for providing accurate and complete delivery information. TRUE TRIBE shall not be liable for failed deliveries, delays, losses, or additional costs resulting from inaccurate or incomplete delivery details provided by the User.
Risk of loss or damage to the Products transfers to the consumer upon physical receipt of the Products by the User or by a third party designated by the User, other than the carrier, in accordance with Article L.216-4 of the French Consumer Code.
Where delivery is delayed beyond the time communicated at checkout, the User may request performance within an additional reasonable period. If delivery is not made within that additional period, the User may cancel the order in accordance with Articles L.216-1 to L.216-8 of the French Consumer Code.
TRUE TRIBE reserves the right to split deliveries where an order contains multiple Products, at no additional cost to the User.
Full details of shipping methods, lead times, and destinations are available in TRUE TRIBE's Shipping Policy, accessible from the footer of the Site.
11 Statutory right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumers have the right to withdraw from a distance contract within 14 calendar days of the day on which the consumer, or a third party designated by the consumer (other than the carrier), physically receives the goods, without giving any reason.
The statutory right of withdrawal described in this Article 11 is a right conferred on consumers by EU, EEA, and United Kingdom law, and applies to orders shipped to destinations within the European Union, the European Economic Area (which, in addition to the EU Member States, comprises Norway, Iceland, and Liechtenstein), and the United Kingdom. For orders shipped to any destination outside the European Union, the European Economic Area, and the United Kingdom, this Article 11 right of withdrawal does not apply, and returns, exchanges, and refunds are governed instead by Article 12.8 below. In all cases, and regardless of shipping destination, the consumer's remedies for defective, damaged, or non-conforming Products and for Products incorrectly shipped are preserved as set out in Articles 12 and 13 and under applicable law.

Refund following withdrawal: TRUE TRIBE will reimburse all payments received from the consumer, including standard delivery costs (except additional costs arising from the choice of a delivery method other than the least expensive standard delivery offered), without undue delay and no later than 14 days from receipt of the returned goods or evidence of their dispatch, whichever is earlier.
Reimbursement will be made using the same payment method as the original transaction, unless the consumer expressly agrees otherwise. No additional fee will be charged.
Return shipping
Standard withdrawal: return costs borne by the consumer.
Defective, damaged, or incorrectly shipped goods: all return costs borne by TRUE TRIBE.
Exceptions (Article L.221-28 of the French Consumer Code): The right of withdrawal does not apply to:
Goods made to the consumer's specifications or clearly personalised, including made-to-measure pieces and items with complimentary embroidery, monogramming, or other custom personalisation requested by the User. Standard catalogue Products that TRUE TRIBE produces on demand after an order are not, by reason of on-demand production alone, treated as made to the consumer's specifications, and the statutory right of withdrawal continues to apply to them;
Sealed goods which are unsuitable for return for hygiene or health-protection reasons and were unsealed after delivery.
12 Return and exchange policy
A considered policy for considered purchases.
As a Parisian fashion house dedicated to handcrafting garments in limited quantities, TRUE TRIBE invites clients to purchase with intention. Our policy reflects our respect for the craftsmanship and materials involved, while fully honouring statutory consumer rights.
12.1 Return Timeframe
In addition to the statutory 14-day right of withdrawal described in Article 11, TRUE TRIBE extends a voluntary return and exchange window of 20 calendar days from the date of receipt. Beyond this period, returns and exchanges will not be accepted except where required by applicable law.
12.2 Remedies
The remedies available on a return depend on the destination to which the order was shipped. For orders shipped to the European Union, the European Economic Area, and the United Kingdom, the following applies. For orders shipped to all other destinations, the remedies set out in Article 12.8 apply in place of the statutory withdrawal refund, while the remedies for defective, damaged, or incorrectly shipped Products apply in all cases regardless of destination.
For orders shipped to the EU, EEA, and United Kingdom, within the statutory 14-day withdrawal period consumers are entitled to a full monetary refund in accordance with Article 11.
For voluntary returns requested between day 15 and day 20 following delivery, TRUE TRIBE offers exchange or store credit as the default remedy. Store credit does not expire.
For defective, damaged, or incorrectly shipped Products, the consumer may request repair, replacement, price reduction, or refund in accordance with the legal guarantees provided under French law.
12.3 Eligibility Conditions
Items must be:
Unused, unworn, and in original condition;
Accompanied by all original tags and packaging intact;
Carefully repacked to ensure safe return.
TRUE TRIBE reserves the right to refuse voluntary returns or exchanges, outside the statutory withdrawal period, where the request appears excessive, abusive, fraudulent, or inconsistent with personal consumer use, including repeated multi-size orders, bulk returns, or signs of wear beyond reasonable inspection. This does not affect any statutory withdrawal right or legal guarantee.
12.4 Exchanges
Subject to stock availability, TRUE TRIBE accepts exchanges for a different size, colour, or alternative Product of equivalent value.
Where the requested replacement Product has a higher price, the User shall pay the difference prior to shipment. Where the replacement Product has a lower price, the difference will be issued as store credit unless otherwise required by applicable law.
Exchange requests are processed only after receipt and inspection of the original returned Product.
TRUE TRIBE reserves the right to refuse repeated or excessive exchange requests where such requests suggest abusive or commercial behaviour inconsistent with personal consumer use.
12.5 Return Procedure
To initiate a return or exchange, Users must contact relations@truetribe.paris and provide their order number together with the reason for return or exchange.
A member of the Client Services team will provide the appropriate return instructions.
12.6 Processing Time
Validated returns, exchanges, and store credits are generally processed within 5 to 7 business days following receipt and inspection of the returned Products.
Statutory refunds are processed no later than 14 days from receipt of the returned goods or proof of shipment, whichever occurs first.
12.7 Discounted and Promotional Items
Products purchased during promotional events or at discounted prices, including Archive sales, Black Sale, seasonal promotions, Black Friday, limited-time reductions, or bundled offers, are not eligible for voluntary exchange or store credit under TRUE TRIBE's extended return policy.
This restriction does not affect the consumer's statutory right of withdrawal under Article 11 or any legal guarantees applicable to defective or non-conforming Products.
12.8 Orders Shipped Outside the EU, EEA, and United Kingdom
This Article 12.8 applies to orders with a delivery address located outside the European Union, the European Economic Area, and the United Kingdom (including, by way of example, the United States, Canada, Switzerland, and other international destinations). In respect of such orders, and unless a mandatory consumer protection rule applicable in the User's country of residence grants broader rights, this Article 12.8 governs returns, exchanges, and refunds in place of the right of withdrawal described in Article 11.
Change-of-mind and incorrect-size returns (store credit or exchange only). Where a User returns a Product covered by this Article 12.8 for any reason other than a defect, damage, or an error by TRUE TRIBE (including, without limitation, change of mind, incorrect size, fit, or colour preference), TRUE TRIBE does not provide a monetary refund. For such returns, the User may choose, at the User's election, either (i) a store credit equal to the price paid for the returned Product, which does not expire, or (ii) an exchange for a different size, colour, or alternative Product of equivalent value, subject to stock availability. Where an exchanged Product has a higher price, the User shall pay the difference prior to shipment; where it has a lower price, the difference will be issued as store credit.
Defective, damaged, or incorrectly shipped Products (refund available). Where a Product covered by this Article 12.8 is defective, damaged on arrival, or not the Product that was ordered (an incorrect item shipped by TRUE TRIBE), the User is entitled, at the User's election, to a replacement of the Product or a full monetary refund of the price paid, together with reimbursement of any return shipping costs incurred. This paragraph reflects rights that, in many jurisdictions, cannot be excluded under applicable consumer protection law (including statutory or implied guarantees that goods be of acceptable quality, as described, and fit for purpose), and nothing in this Article 12.8 limits any such non-excludable right available to the User under the law of the User's country or state of residence.
Return shipping, timeframe, and condition. For change-of-mind and incorrect-size returns under this Article 12.8, the cost of return shipping is borne by the User. For defective, damaged, or incorrectly shipped Products, return shipping is borne by TRUE TRIBE. Returns and exchanges under this Article 12.8 must be requested within 20 calendar days of delivery, and the Product must be unused, unworn, and in original condition with all original tags and packaging intact, in accordance with the eligibility conditions in Article 12.3. To initiate a return or exchange, the User must contact relations@truetribe.paris with the order number and the reason for the return, in accordance with Article 12.5.
Products purchased during promotional events or at discounted prices remain subject to Article 12.7. Where any provision of this Article 12.8 conflicts with a mandatory consumer protection right available to the User under the law of the User's country or state of residence, that mandatory right prevails to the extent required by law.
13 Quality and legal warranties
TRUE TRIBE warrants its Products in accordance with the following statutory guarantees, which cannot be excluded or limited:
Legal guarantee of conformity (Articles L.217-1 to L.217-32 of the French Consumer Code);
Guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
Consumers may invoke these guarantees in accordance with the applicable statutory periods under French law.
Beyond these statutory obligations, TRUE TRIBE does not warrant that the Products will meet any particular expectations or be suitable for any purpose not specified in the product description.
13.1 Commercial Satisfaction Guarantee (Free Repairs)
TRUE TRIBE offers a voluntary commercial satisfaction guarantee, additional to and separate from the statutory guarantees above. TRUE TRIBE garments are designed to endure. Where a garment tears or does not live up to TRUE TRIBE's quality standards as a result of a manufacturing or material defect, TRUE TRIBE undertakes to repair the garment free of charge, where reasonably possible.
To request a repair under this commercial guarantee, the User may contact relations@truetribe.paris with details of the garment and the issue. This commercial guarantee:
Is offered free of charge by TRUE TRIBE in addition to the statutory legal guarantees;
Does not replace or limit the statutory guarantees set out above;
Excludes damage resulting from normal wear and tear, accidental damage, misuse, improper care, or alterations made by third parties;
Is subject to availability of materials and the technical feasibility of the requested repair.
In line with Article L.217-22 of the French Consumer Code, the existence of this commercial guarantee does not affect, and is in addition to, the consumer's right to invoke the legal guarantee of conformity or the guarantee against hidden defects.
14 Order cancellation and service modification
TRUE TRIBE reserves the right to refuse, modify, suspend, or discontinue the Service (or any part thereof), subject to the following:
Where an order has already been accepted and confirmed, cancellation by TRUE TRIBE will give rise to a full refund of any amounts paid by the User.
Where the Service is suspended or discontinued prospectively, no refund obligation arises in respect of services not yet rendered.
TRUE TRIBE will make reasonable efforts to notify the User by email or telephone using the contact details provided at checkout.
15 Force majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from an event of force majeure, namely an event beyond the reasonable control of the party concerned, including but not limited to:
Natural disasters (earthquakes, floods, storms, fires);
Epidemics, pandemics, or public health emergencies;
War, terrorism, civil unrest, or acts of public authority;
Strikes, labour disputes, or industrial action;
Failure or interruption of telecommunications, internet, e-commerce platforms, or transport networks;
Supply chain disruption, raw material shortages, or carrier failures;
Government action, embargoes, sanctions, or changes in applicable law.
The party affected by an event of force majeure shall notify the other party as soon as reasonably practicable and shall use reasonable efforts to mitigate the effects of the event.
If the event of force majeure continues for more than 60 days, either party may terminate the affected contract by written notice. In such case, TRUE TRIBE shall refund any amounts paid for Products not yet delivered, without further liability.
16 Third-party tools and integrations
The Site is operated on the Shopify e-commerce platform and integrates a number of third-party tools, including payment processors (Shopify Payments, PayPal, Apple Pay, Shop Pay), shipping carriers, analytics tools (Google Analytics, Shopify Analytics), and marketing tools (Meta Pixel, Google Ads, and similar), over which TRUE TRIBE does not exercise direct control.
Such tools are provided on an "as is" and "as available" basis. Where third-party tools process personal data, the relevant third-party processor acts under a data processing agreement with TRUE TRIBE in accordance with Article 28 of the General Data Protection Regulation (GDPR). Users may consult TRUE TRIBE's Privacy Policy and Cookie Policy for further information on the data processors used.
Users should review the applicable terms of any third-party provider before engaging with their services.
17 Third-party links and social media
The Site may contain hyperlinks to third-party websites and to TRUE TRIBE's official social media channels (including Instagram, YouTube, TikTok, LinkedIn, and Spotify). The inclusion of any link does not imply endorsement, approval, or affiliation with the third-party website. TRUE TRIBE accepts no responsibility for the content, accuracy, or practices of third-party websites, and Users are encouraged to review their terms and privacy policies before engaging with them.
18 User comments, feedback and submissions
Where Users submit comments, feedback, reviews, or other materials to TRUE TRIBE, whether solicited or unsolicited, via the Site, by email, or by any other means ("Submissions"), the User grants TRUE TRIBE a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, adapt, publish, translate, and distribute such Submissions in any media, for purposes related to the operation and promotion of the Site and its Products.
This licence does not affect the User's ownership of their Submissions or their moral rights under French intellectual property law.
User-generated content (social media campaigns)
Where TRUE TRIBE invites Users to participate in social media campaigns, branded hashtag initiatives, "share your look" features, tagged content programmes on Instagram, TikTok, or YouTube, or similar user-generated content ("UGC") programmes, participating Users grant TRUE TRIBE a non-exclusive, royalty-free, worldwide licence to reproduce, display, and distribute the submitted images, videos, or content on TRUE TRIBE's Site, marketing channels, and social media accounts, for the duration of the relevant campaign and for a reasonable archival period thereafter.
Participation by submitting or tagging content (for example, use of a campaign hashtag) does not by itself authorise the use of that content, or of any identifiable individual appearing in it, in paid advertising. Before using UGC that features an identifiable person in paid or sponsored advertising, TRUE TRIBE will obtain that person's express confirmation (for example, by direct message, email, or platform reply), constituting both a licence to use the content and consent to the use of the individual's image. This consent may be withdrawn for future use at any time by contacting contact@truetribe.paris, and TRUE TRIBE processes any associated personal data in accordance with its Privacy Policy.
Participating Users warrant that:
They are the author or rights-holder of the submitted content;
Any identifiable individuals appearing in the content have consented to its publication;
The content does not infringe any third-party rights.
Users may request the removal of their user-generated content at any time by contacting contact@truetribe.paris.
Submission warranties: Users warrant that their Submissions and user-generated content:
Do not infringe the intellectual property, privacy, or other rights of any third party;
Are not unlawful, defamatory, abusive, obscene, or otherwise objectionable;
Do not contain viruses or harmful code;
Accurately represent the User's identity.
TRUE TRIBE may, at its discretion, moderate, edit, or remove Submissions or user-generated content that violate these conditions.
19 Personal data protection
TRUE TRIBE processes personal data in its capacity as data controller in accordance with:
Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR");
The French Data Protection Act (Loi Informatique et Libertés, as amended);
All other applicable data protection legislation.
Legal bases for processing: (i) performance of a contract (order processing and delivery); (ii) compliance with legal obligations (invoicing, accounting, fraud prevention); (iii) legitimate interests (internal statistics, site improvements); and (iv) consent, where separately and specifically obtained.
Purposes of processing:
Processing and fulfilling orders;
Invoicing and payment processing;
Customer service and after-sales support;
Fraud detection and prevention;
Compliance with legal obligations;
Internal statistical analysis.
Data retention (purpose-specific):
Order and transactional data: 10 years (French commercial and accounting law);
Customer account data: duration of the account, plus 3 years from last activity;
Marketing communications data (consent-based): until withdrawal of consent or 3 years from last contact.
Data sharing: Personal data may be shared with trusted service providers (Shopify as e-commerce platform processor, OVH as infrastructure provider, payment processors, shipping carriers, IT providers, marketing platforms) strictly for the purposes set out above. TRUE TRIBE does not sell personal data to third parties. Data may be disclosed where required by law.
User rights (GDPR Articles 15 to 22): Users have the right to:
Access their personal data;
Rectify inaccurate or incomplete data;
Request erasure of their data, subject to applicable legal retention obligations;
Object to processing based on legitimate interests;
Request restriction of processing;
Receive their data in a portable format;
Withdraw consent at any time, where processing is based on consent.

Users also have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) at www.cnil.fr.

20 Cookies and tracking technologies
The Site uses cookies and similar tracking technologies for site operation, analytics, and, where consent has been obtained, marketing. This includes essential Shopify platform cookies, analytics cookies (such as Google Analytics and Shopify Analytics), and, where consented, marketing cookies (such as Meta Pixel and Google Ads). Users are informed of and may manage their cookie preferences via the cookie consent banner displayed upon first visit. Further information is available in the Cookie Policy.
21 Prohibited uses
In addition to the prohibitions set out in Article 4, the User is prohibited from using the Site or its content:
For any unlawful purpose, or to solicit others to engage in unlawful acts;
To violate any applicable international, national, or local laws or regulations;
To infringe the intellectual property rights of TRUE TRIBE or any third party;
To harass, abuse, insult, harm, defame, intimidate, or discriminate on grounds of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
To submit false or misleading information;
To upload or transmit viruses or malicious code;
To collect or harvest the personal information of others without consent;
To engage in spam, phishing, pharming, pretexting, spidering, crawling, or unauthorised scraping;
For any obscene or immoral purpose;
To circumvent or interfere with the security features of the Site.
TRUE TRIBE reserves the right to terminate access for any User found to be in violation of the above.
22 Errors, inaccuracies and omissions
The Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times, or availability. TRUE TRIBE reserves the right to correct such errors and to amend or cancel orders where the error is material, including after submission.
Where an order is cancelled due to a pricing or availability error, any amounts paid by the User will be refunded in full without delay.
TRUE TRIBE assumes no general obligation to update, amend, or clarify information on the Site, except as required by law.
23 Limitation of liability
To the fullest extent permitted by applicable law, and subject to the carve-outs set out below, TRUE TRIBE's total liability to any User in connection with the Site, Products, or Services shall not exceed the total amount paid by that User in respect of the specific order giving rise to the claim.
TRUE TRIBE shall not be liable for:
Any indirect, incidental, special, or consequential losses;
Loss of profits, loss of data, or loss of business opportunity;
Damages arising from circumstances beyond TRUE TRIBE's reasonable control, including force majeure events as defined in Article 15, e-commerce platform failures, network failures, or third-party outages.
Mandatory carve-outs: Nothing in these Terms excludes or limits TRUE TRIBE's liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Any liability that cannot be excluded under French or EU law, including mandatory consumer protection rights.
The legal guarantees of conformity and against hidden defects set out in Article 13 are not affected by this clause.
24 Indemnity
The User agrees to indemnify and hold harmless TRUE TRIBE, its directors, officers, employees, agents, and representatives from and against any third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with:
Any breach by the User of these Terms;
Any infringement by the User of the intellectual property rights of TRUE TRIBE or any third party;
Any fraudulent, negligent, or wilful misconduct by the User in connection with the use of the Site.
25 Alternative dispute resolution and consumer complaints
In accordance with Articles L.612-1 et seq. of the French Consumer Code and EU Directive 2013/11/EU on alternative dispute resolution for consumer disputes, TRUE TRIBE informs consumers of their right to use a certified Alternative Dispute Resolution (ADR) mediator free of charge before bringing legal proceedings.
Before initiating any formal mediation or legal proceedings, the consumer is invited to contact TRUE TRIBE Customer Service in writing at contact@truetribe.paris to seek an amicable resolution. TRUE TRIBE undertakes to respond promptly and to make reasonable efforts to resolve the matter directly.
In accordance with Articles L.616-1 and L.616-2 of the French Consumer Code, TRUE TRIBE has joined a certified consumer mediation scheme. Consumers may refer a dispute, free of charge, to the appointed mediator after first contacting TRUE TRIBE Client Services in writing at relations@truetribe.paris and allowing a reasonable period for an amicable resolution. The appointed mediator is:

CM2C is approved by the French Commission d'évaluation et de contrôle de la médiation de la consommation (CECMC). Mediation is free of charge for the consumer and is conducted in French.
Consumers established in the European Union may also use the relevant national or EU consumer dispute resolution mechanisms available to them. The consumer's right to bring proceedings before a competent court is not affected.
Use of mediation is voluntary. The consumer's right to bring proceedings before a competent court is not affected by this clause.
26 Governing law and jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of France, without prejudice to any mandatory consumer protection rights that the User may benefit from under the laws of their country of habitual residence.
In the event of a dispute that cannot be resolved by mediation:
For disputes initiated by TRUE TRIBE against a User, the courts of Paris shall have exclusive jurisdiction.
For disputes initiated by a consumer User, the consumer may bring proceedings before the competent court of their country of domicile, in accordance with EU Regulation No. 1215/2012 (Brussels I Recast) and applicable French procedural law.
Prior to any legal proceedings, the parties agree to use best efforts to resolve the dispute amicably, including through the ADR process described in Article 25.
27 Severability and entire agreement
If any provision of these Terms is found by a competent court or authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, Cookie Policy, Return and Exchange Policy, Shipping Policy, and any other policies expressly referenced herein, constitute the entire agreement between the User and TRUE TRIBE in relation to the use of the Site and the purchase of Products, and supersede all prior agreements, representations, or understandings.
28 Amendments to these Terms
The most current version of these Terms is accessible at all times on the Site. TRUE TRIBE reserves the right to update or replace these Terms at its sole discretion. The version number and effective date of the most recent revision are indicated at the top of this document.
It is the User's responsibility to review these Terms prior to each use of the Site or placement of an order. Continued use of the Site following the posting of any changes constitutes acceptance of those changes. Where changes are material, TRUE TRIBE will endeavour to provide reasonable advance notice to registered Users by email.
